  • Katipuss` UE diary : Lowells Shop Direct

    Hi everyone

    I am new to posting but have been following some UE threads for a while and using the info to try and sort out Lowells! I have received my CCA today and would like to know if it is unenforceable. If it isn`t then i`d like some advice on my next step. Hope i have done this correctly.....?

    09.08.2013 All not lost! going to SAR littlewoods and send letter to Lowells informing them to wait 40 days!
    10.08.2013 am adding my other debts too - scroll down as i always do everything arse around!
    12.08.2013 SAR sent to Littlewoods and 40 day holding letter sent to Lowells
    04.09.2013 Received letter from Lowells: Put account on hold for 60 days
    04.09.2013 Received SAR info from Shop Direct
    05.11.2013 Received letter from Lowells saying they are going to access my credit file to determine their next steps (i.e:court or door step agent)
    06.11.2013 Niddy`s letter sent to Lowells (see page 3 of diary)
    18.11.2013 Received letter from Lowells saying they have received my complaint and will be investigating thoroughly!
    06.01.2014 Received letter from Lowells apologising for any distress caused and they have closed my account!!! WOO HOO!!!!

      12.11.2013 Received Default Notice from Mercers
      10.12.2013 Received `Important notice` from Mercers saying they are passing my account to a specialist collections company who may call at my address. Going to ignore and see who knocks on the door!

        10.12.2103 Received letter asking me to contact Aqua to set up repayment plan - still not received CCA so ignoring letter as account in dispute now.

            Date commenced: Definitely before 2006 ( from 2006 in my married name)

            Date last paid: December 2011 (cap 1 wouldn`t accept my offer of repayment)

            Are you on arrangement?: No

            Status: Not sure! Was sent to Capquest and Cougar who i ignored and then sent back to Cap 1 who sent it to Scotcall who i ignored who sent it back to Cap.1 who sent me a strange letter in December 2012 which i ignored and have heard no more since! Will upload strange letter when i figure out how to!

            Account owner: not sure!

                SDG (Littlewoods) can't be UE as its post 04/07..... Hence the provisions of s.127 are repealed.

                Its more the status of default/termination. UE is not an option sadly.
                I'm the forum administrator and I look after the theme & features, our volunteers & users and also look after any complaints or Data Protection queries that pass through the forum or main website.                   This is where is gets messy because i was sure i opened this account late 2006/2007 and i did it online.

                  However the cca has my signature on it when i signed in 2008. Littlewoods sent me a cca in the post which i signed and sent back and it is a copy of this which Lowells have sent to me.

                  I`m going through all my papers now to see if i have any statements from 2006 - not holding out much hope though......

                    ok send over what you've got. I suspect that you've taken a higher valued purchase at the time of the agreement which is usual. Can you clarify did you purchase anything big that could have utilised a buy now pay later deal ie a tv/sofa/furniture etc

                    that could explain the new signed agreement. Online wasn't much better btw

                    A SAR will get the true details. I'd SAR them then we'll know as it'll show all payments from inception along with ALL purchases.

                      I`ll re-scan what Lowells sent and get it to you as soon as i can.

                      It`s a shame i haven`t saved all my paperwork from Littlewoods - i`ve just found an email surprisingly that they sent in Aug 2008 welcoming me to Littlewoods - but this is all i have...nothing before that.....so i could be wrong on the 2006 date. I remember ordering something in 2006 online and sending it back so maybe this is what i`m thinking of. (sticks in my mind because it was something for my wedding!)

                      I`ve had so many debt worries and crap that i`ve probably lost my marbles!

                      I purchased some bunk beds from Littlewoods - i remember that - but not the date - oh i`m hopeless!

                      I`ll do the SARS and see what it brings up - if nothing else it will buy me some time as i`m going on holiday next weekend and Lowells want me to get in touch with them in 14 days.

                      Shall i SARS Lowells or Littlewoods or both?

                          Then send something like this to lowells;

                          Ref: xxxxxxxx

                          I write with reference to previous correspondence and thank you for sending the agreement as per my previous request.

                          There is some ambiguity towards what has been sent so I've sent Littlewoods a Subject Access Request, in line with s.7 Data Protection Act (1998) in the hope my queries will be resolved. In the meantime please note I'll not be in a position to discuss things until such time Littlewoods comply with my request and therefore request you cease & desist from writing for the next 40 days, by which time I expect a reply from Littlewoods.

                              Err! Nothing usually except a 10bob CD of account numbers and amounts bought off e-bay for a pittance

                              Every single question I had to Lowells had to be referred back to OC.
